How LinkScale handles copyright infringement claims under the Digital Millennium Copyright Act.

1. Overview
This policy outlines LinkScale's procedures for handling Digital Millennium Copyright Act (DMCA) violations on our platform. LinkScale respects the intellectual property rights of others and expects its users to do the same.
2. How to Report a DMCA Violation
Copyright holders can report violations using our Abuse Report form or by contacting our Designated Copyright Agent directly at [email protected].
3. Procedures
Before filing a Notice of Infringement with LinkScale, copyright owners must:
- Conduct due diligence to verify ownership of the copyrighted work.
- Confirm that content on LinkScale-hosted pages constitutes unauthorized use.
- Attempt resolution directly with the page owner/administrator when possible.
3.1 Filing a Notice of Infringement
When confirmed infringement exists, the complainant should submit a Notice of Infringement through our Designated Agent with all statutory requirements included and sufficient detail.
Upon receipt, LinkScale will notify the page owner of the copyright claim. Note that LinkScale cannot prevent users from creating new pages or links with similar content.
3.2 Resolving the Infringement
- Entirety infringement: LinkScale disables the complete page or link.
- Partial infringement: LinkScale may disable specific pages or links only.
LinkScale cannot remove specific content from user pages; it can only disable access to pages and links created through its platform.
4. Notice of Infringement Requirements
Per DMCA Section 512(c)(3), notices must include:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work(s) claimed to be infringed, with URLs or references.
- Precise identification of the infringing material and its location on LinkScale.
- Contact information (name, address, phone number, email address).
- A good faith statement that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate.
- A statement, under penalty of perjury, that the complainant is authorized to act on behalf of the copyright owner.
Incomplete notices may be ineffective. False claims expose filers to liability for damages, costs, and attorney fees.
5. Counter-Notification Process
Users who believe their content was wrongfully removed may file a Counter-Notification per DMCA Section 512(g)(2)-(3) through LinkScale's Designated Agent.
5.1 Counter-Notification Requirements
- A physical or electronic signature.
- Identification of the removed material and its former location.
- Contact information.
- A good faith statement that removal resulted from mistake or misidentification.
- Consent to the jurisdiction of the relevant courts and acceptance of service of process.
LinkScale will restore content within 10-14 business days unless the original complainant files a court action.
Knowingly and materially misrepresenting removal circumstances creates liability for damages and legal fees.
6. Repeat Offenders Policy
LinkScale reserves the right to disable and/or terminate accounts of users who repeatedly infringe copyrights or intellectual property rights of others.
