These Terms and Conditions ("Terms") are a binding agreement between you ("User," "you," or "your") and RM ECOM, SASU, the company that operates LinkScale (the "Service," "we," "us," or "our"). By creating an account, or by accessing or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Service.

The Community Standards, the DMCA Policy and the Privacy Policy are part of these Terms. If you use the Service on behalf of a company, an agency or another person, you confirm that you have the authority to bind them, and "you" then refers to both you and them.

• Account: the access you create to use the Service, together with the projects and team members attached to it.
• Content: everything you create, upload, configure or point to through the Service, including links, destinations, landing pages, sites, templates, images, texts, forms and domains.
• Link: any address served by the Service on your behalf, whether it redirects to a destination or displays a page.
• Visitor: any person or automated system that opens one of your Links.
• Third-Party Platform: any service we do not operate, including social networks, messaging apps, creator and subscription platforms, payment providers, app stores, browsers and domain registrars.

• You must be at least 18 years old and legally able to enter into a contract.
• The Service is designed for professional and commercial use. You confirm that you use it in the course of a business, creator or professional activity.
• You may not use the Service if you are barred from doing so under any applicable law, including sanctions and export control rules, or if we previously closed an account of yours for a breach of these Terms.
• We may refuse, at our discretion, to open an account or to provide the Service to anyone.

• You must provide accurate, current information and keep it up to date, including a working email address. Notices sent to that address are deemed received.
• You are responsible for keeping your password, API keys, access tokens and any other credential confidential, and for everything done with them, whether or not you authorised it.
• You are responsible for the people you invite to your projects and for the permissions you give them. Their actions are treated as yours.
• If you manage Links for other people, such as creators or clients, you confirm that you are authorised to do so and you remain responsible to us for that use.
• You must tell us without delay if you suspect unauthorised access to your Account. We are not liable for losses caused by credentials you failed to protect.
• Accounts may not be sold, rented or transferred without our written consent.

• The Service provides tools for creating landing pages, redirect links, and analytics.
• We act solely as a technical intermediary.
• We do not create, edit, or endorse user content, nor do we control how links are shared externally by users.
• We do not sell, deliver or guarantee anything offered on the destinations your Links point to, and we are not a party to any transaction between you and your Visitors.

A link-in-bio tool only has value on platforms we do not own. You understand and accept the following:

• No affiliation. LinkScale is an independent service. It is not affiliated with, endorsed by or sponsored by Instagram, Facebook, Meta, TikTok, X, Snapchat, Telegram, YouTube, Reddit, OnlyFans, Fanvue, MYM or any other Third-Party Platform. Their names and logos belong to their owners and are used only to identify them.
• Their rules are yours to follow. You are solely responsible for complying with the terms, policies and community guidelines of every Third-Party Platform on which you share a Link or which a Link points to, including their rules on external links, adult content, advertising and automation.
• Their decisions are theirs. A Third-Party Platform may at any time restrict, flag, demote, block or remove a Link, a domain, a post or an account. We have no control over those decisions and accept no liability for them, including for lost followers, reach, revenue or accounts.
• They change without notice. Third-Party Platforms regularly change how their apps, in-app browsers, link previews and programming interfaces behave. A feature that depends on them may stop working, fully or partly, at any time. This is not a breach of these Terms and does not entitle you to a refund.

Links, redirects and opening in an external browser

• Features that open a Link outside an in-app browser, or that open a destination in a specific app, rely on behaviours of operating systems and applications we do not control. They are provided on a best-effort basis, without any guarantee that they work on every device, application or version.

Traffic filtering and protection

• Features that filter traffic, such as bot detection, country, device or source rules, are tools to protect your Links against abuse and unwanted traffic. No filter is perfect: some unwanted requests will pass and some genuine Visitors may be filtered.
• You decide how these features are configured and you are solely responsible for that configuration. You must not use them to deceive Visitors, to hide illegal content, or to circumvent a law or the enforcement of rules that apply to you.

Analytics, tests and attribution

• Statistics, visitor counts, click rates, test results, revenue attribution and currency conversions are estimates produced from the data available to us. They may differ from the figures of Third-Party Platforms and may be incomplete, delayed or revised.
• They are provided for information only. You should not rely on them as the sole basis for a financial, tax, accounting or legal decision.

Connected accounts and integrations

• When you connect a Third-Party Platform account, you authorise us to access it and to retrieve, store and display its data on your behalf, for as long as the connection exists. You confirm that the account is yours or that its owner has authorised you.
• You are responsible for making sure that connecting the account is permitted by the terms of that platform. An integration may be interrupted or withdrawn at any time, in particular if the platform changes or restricts access.

AI features

• Some features generate or modify texts, pages, images or other material using artificial intelligence. That output may be inaccurate, incomplete, unsuitable or similar to output produced for other users. You must review it before using or publishing it, and you are responsible for it exactly as for any other Content.
• You must hold all the rights and consents needed for anything you submit to an AI feature, including for any real person who appears in it, and you must not use these features to produce illegal, deceptive or non-consensual material.
• AI features may be subject to usage limits or credits, which have no cash value and are not refundable.

API, extensions and automations

• Access through our programming interfaces, browser extension, connectors, bots and scheduled automations is subject to these Terms and to the technical limits we set. We may throttle, suspend or revoke that access to protect the Service.

Beta and preview features

• Features identified as beta, preview or early access are provided for evaluation, may change or be withdrawn at any time, and are excluded from any commitment we make elsewhere.

• If you connect your own domain, you are responsible for its registration, its renewal and its DNS configuration. We are not liable for a Link that stops working because a domain expired, was misconfigured, or was suspended by its registrar or registry.
• Domains purchased through the Service are registered with third-party registrars and are subject to their terms and to the policies of the relevant registry and of ICANN. A domain name is available only once its registration is confirmed, and its price may differ from one name to another.
• Domain purchases and renewals are final and non-refundable once the order is placed with the registrar. A renewal depends on a successful payment in time; we do not guarantee that a domain is renewed if a payment fails, is disputed, or if your subscription has ended.
• You must not register or use a domain that infringes a trademark or other right of a third party, and you remain solely responsible for any dispute about a domain you chose.
• Shared domains that we make available remain ours. We may withdraw or replace a shared domain at any time, in particular if it is flagged or blocked by a Third-Party Platform.

You agree that you are fully and exclusively responsible for:

• All content, websites, files, and resources you host, link, or redirect traffic to.
• The accuracy, legality, and compliance of such content with all applicable laws and regulations.
• The consequences of distributing, promoting, or redirecting to third-party material.
• Holding every right, licence, consent and release needed for your Content, including for any person who appears in it.
• Any age restriction, labelling, verification or record-keeping obligation that applies to your Content or to the destinations of your Links, in every country where your Links are available.
• Your own commercial, tax, advertising and consumer law obligations towards your Visitors and customers, including the disclosure of sponsored or affiliate content.

You acknowledge that LinkScale has no obligation to monitor your use but reserves the right to investigate suspected violations.

You must follow our Community Standards at all times. In addition, you must not, and must not allow anyone else to:

• use the Service for phishing, malware, scams, impersonation, spam or any deceptive or fraudulent purpose;
• host, link to or promote any material that sexualises minors, any non-consensual intimate content, or any other illegal content;
• mislead Visitors about where a Link leads in order to harm or defraud them;
• generate artificial traffic, clicks or statistics, or manipulate analytics;
• probe, scan, overload or disrupt the Service, bypass its security or usage limits, or access data that is not yours;
• copy, scrape, reverse engineer, decompile or resell the Service, or use it to build a competing product, except where the law expressly allows it;
• create accounts by automated means, or open a new account to evade a suspension or a ban;
• use the Service in a way that damages the reputation of our domains or infrastructure, for example by causing them to be blocklisted.

We decide, acting reasonably, whether a use breaks these rules. A breach of this section is a material breach of these Terms.

• For the personal data of your Visitors that the Service collects on your behalf, such as visit statistics, form submissions, leads and bookings, you are the data controller and we act as your processor. The data processing terms set out in our Privacy Policy apply between us and form part of these Terms.
• You are responsible for informing your Visitors, for obtaining any consent the law requires (including for cookies, tracking pixels and marketing messages you add to your pages), and for answering their requests about their data.
• You must not use the Service to collect special categories of data, such as health data, payment card numbers, government identifiers or passwords, unless we have agreed to it in writing.
• You must use the Visitor data you obtain through the Service lawfully, and only for purposes your Visitors were told about.

Monitoring of links and landing pages

• We reserve the right, but not the obligation, to monitor, review, and investigate links, landing pages, and redirections created through the Service.
• Monitoring may be carried out using automated tools, manual checks, or third-party resources.
• We do not guarantee comprehensive or continuous monitoring, and the absence of intervention does not imply approval of any particular content.

Illegal content and activities

• Users are strictly prohibited from using the Service to host, redirect, or promote any content or activity that is illegal under applicable local, national, or international laws and regulations.
• Any use of the Service for unlawful purposes constitutes a material breach of these Terms.

User distribution of links outside the Service

• We do not monitor, track, or control how or where links generated by users are distributed or shared outside of the Service (including but not limited to social media platforms, messaging apps, websites, or emails).
• Users are solely and exclusively responsible for the distribution, communication, and promotion of their links outside the Service.
• Any liability arising from the misuse of links outside the Service rests entirely with the user.

Enforcement measures

• We reserve the right, at our sole discretion, to suspend, restrict, or permanently terminate accounts suspected of violating these Terms or applicable law.
• We may remove, disable, or block access to specific links or landing pages without prior notice.
• We may limit traffic, features or usage where an Account creates a security, legal or operational risk for the Service or for other users.
• We may preserve and disclose information to competent authorities where legally required, including in response to lawful requests, court orders, or regulatory investigations.
• Enforcement actions may be taken regardless of whether a violation was intentional or unintentional, and do not entitle you to a refund or to compensation.

Notice & takedown process

• Anyone can report a Link through our abuse report form. If we receive a valid complaint or legal notice regarding content linked or hosted via the Service, we may remove or disable the relevant content pending investigation.
• Users will be notified where feasible, with the reasons for the decision, except where prohibited by law or where notification would interfere with law enforcement activities.
• We may reinstate or permanently disable the content or account, at our sole discretion, following review.

Contesting a decision

• If you believe an enforcement decision is wrong, you may contest it within six months by writing to thomas at linkscale.to with the Link or Account concerned and your reasons. A person reviews every such request.

Limitation of liability (content-specific)

• We are not responsible for content created or hosted by users, except to the extent required by law once notified of unlawful material.
• We disclaim liability for damages arising from user-generated content, third-party websites, or the manner in which users share their links.

Your content

• Users retain rights over their content.
• By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, reproduce, adapt for technical purposes, process, and transmit your content solely for providing, securing and improving the Service. It ends when the content is deleted, except for backups that expire on their normal schedule.

Our service

• The Service, its software, design, templates, documentation, trademarks and logos belong to us or to our licensors. These Terms give you a personal, non-exclusive, non-transferable and revocable right to use the Service for the duration of your subscription, and nothing more.
• Templates and design elements we provide may be used only within the Service.
• If you send us suggestions or feedback, we may use them freely, without any obligation to you.

Infringement claims

• If you believe a link or landing page infringes your rights, please contact us at thomas at linkscale.to for takedown under our Notice & Takedown Policy.
• We may close the Accounts of users who infringe the rights of others repeatedly.

Billing

• Paid features and subscriptions are billed as specified during purchase.
• Subscriptions are billed in advance and renew automatically for the same period, at the price then in force, until you cancel. By subscribing you authorise us and our payment provider to charge your payment method for each renewal, and for any add-on, domain or usage you order.
• Prices are shown exclusive of taxes unless stated otherwise. You are responsible for all taxes that apply to your purchase, and the currency you are billed in may depend on your country.
• We may change our prices. A new price applies from your next renewal, after we have told you in advance, and you may cancel before it takes effect.
• Trials, credits, discounts and promotional offers apply only on the conditions shown when they are offered, cannot be combined unless we say so, and have no cash value.

Cancellation and refunds

• You can cancel a subscription at any time from your Account. Cancellation takes effect at the end of the period already paid, and you keep access until then.
• All fees are non-refundable, except where required by law. This includes partly used periods, unused features or credits, downgrades, and Accounts suspended or closed for a breach of these Terms.
• If you are a consumer with a statutory right of withdrawal, you ask us to start providing the Service immediately on purchase. If you then withdraw within the legal period, you owe us an amount proportionate to the Service provided up to that point.

Failed and disputed payments

• We may suspend or terminate unpaid accounts. If a payment fails, we may retry it, restrict paid features, and disable your Links until the balance is settled.
• Amounts not paid on time may bear late-payment interest and, for business customers, the fixed recovery fee provided for by French law.
• If you believe a charge is wrong, contact us first: we will look into it. Opening a payment dispute or chargeback without doing so may lead to the suspension of your Account while it is pending.

• We work to keep the Service and your Links available, but we do not commit to any level of availability, speed or response time. The Service may be interrupted for maintenance, security reasons, or causes outside our control.
• We may add, change, limit or remove features at any time. If we withdraw a paid feature that is material to your subscription, you may cancel and stop being charged from the next period.
• We may set and adjust reasonable limits on usage, such as the number of Links, requests, visits, storage, team members or AI operations, including where a plan is described as unlimited, in order to protect the Service against abuse.
• We keep backups for our own continuity purposes, not as a service to you. You are responsible for keeping your own copy of any Content and data that matter to you.

• You may stop using the Service and close your Account at any time.
• We may suspend or terminate your account, at our sole discretion, with or without cause or notice.
• When an Account is closed or a subscription ends, your right to use the Service stops: your Links, pages and domains may stop working immediately and without redirection, and your Content and statistics may be deleted. Export what you need beforehand; we are not obliged to keep or return it afterwards.
• We may reassign or reuse the address of a deleted Link on a shared domain.
• Termination does not relieve you of obligations accrued prior to termination, including amounts due.
• Sections on responsibility, indemnification, disclaimers, limitations, and governing law shall survive termination, together with any other section that by its nature should.

You agree to defend, indemnify, and hold harmless LinkScale, its affiliates, employees, officers, and partners from and against any and all claims, damages, liabilities, losses, fines, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the Service.
• Content you create, host, or redirect to.
• Violation of these Terms or applicable law.
• Any breach of the terms or policies of a Third-Party Platform, and any claim that platform brings as a result.
• Any claim by a Visitor, a customer of yours, or a person whose data, image or rights are involved in your Content.
• The acts of anyone using your Account or your credentials.

This obligation survives termination of your account.

The Service is provided strictly "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including but not limited to:

• Merchantability, fitness for a particular purpose, or non-infringement.
• Availability or accuracy of analytics.
• Compliance of user content with laws or third-party rights.
• Uninterrupted, error-free or secure operation, and the absence of data loss.
• Any commercial result, including traffic, conversions, revenue, followers or reach.
• The continued acceptance of your Links, domains or accounts by any Third-Party Platform, and the continued operation of any feature that depends on one.

Nothing we publish, including our website, guides, support answers and AI output, is legal, tax or financial advice. You use the Service entirely at your own risk.

To the maximum extent permitted by law:

• Our total liability to you for any claim shall not exceed the total amount you paid us in the last 12 months, regardless of the cause of action.
• We shall not be liable for indirect, incidental, punitive, or consequential damages; loss of revenue, profits, goodwill, data, or business opportunities; or content or actions of third parties.
• We shall not be liable for the suspension, restriction or loss of an account, a Link, a domain, an audience or earnings on a Third-Party Platform, whatever the reason.
• Any claim against us must be brought within one year of the event giving rise to it, after which it is barred.

These limits reflect the price of the Service and the allocation of risk between us. Nothing in these Terms excludes or limits a liability that cannot be excluded or limited by law, such as liability for fraud, gross negligence, death or personal injury, or the mandatory rights of a consumer.

We are not liable for any failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, cyberattacks, government actions, labor disputes, acts of war, and the failure, decision or change of policy of a hosting, network, payment, registrar or other Third-Party Platform.

These Terms shall be governed by the laws of France. All disputes shall be resolved exclusively before the courts of France.

Before going to court, you agree to write to us and to give us 30 days to try to resolve the matter amicably. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and the right to bring proceedings before its courts.

• Entire agreement. These Terms, the documents they refer to and the details of your order are the whole agreement between us about the Service, and replace any earlier discussion or statement.
• No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
• Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to an affiliate or to a successor in a merger, an acquisition or a sale of assets.
• Independent parties. Nothing in these Terms creates a partnership, an agency, an employment or a joint venture between you and us.
• Notices and evidence. We may send you notices by email or within the Service. Our electronic records, such as logs, timestamps and billing records, are admissible as evidence of your use of the Service, unless you prove otherwise.
• Language. These Terms are written in English. If a translation is provided, the English version prevails.

If any provision of these Terms is found unenforceable, it applies to the fullest extent the law allows and the remaining provisions shall remain in full force and effect.

We may modify these Terms at any time. Updates will be posted on our website, and we will give account holders reasonable prior notice of any material change. Continued use of the Service after a change takes effect constitutes acceptance of revised Terms; if you do not agree, you must stop using the Service and may cancel your subscription.
